Lost Records: Bloom and Rage – Cover to Cover Contest: Terms and Conditions

1. Introduction


1.1. These terms and conditions (the “Terms”) apply to the Lost Records: Bloom and Rage – Cover to Cover Contest (the “Contest”) conducted by Don’t Nod Entertainment, a limited company located at 11 rue de Cambrai – Parc du Pont de Flandre – 75019 Paris (the “Promoter”).

2. Eligibility


2.1. The Contest is open to legal residents of Europe and North America aged 16 years or over at the time of entry.


2.2. Employees of the Promoter, its affiliates, subsidiaries, advertising and promotion agencies, and immediate family members or those living in the same household are not eligible to enter.


3. How to Enter


3.1. The Contest begins on January 24th, 2025 at 6pm CET and ends on February 14th, 2024 at 6pm CET (“Contest Period”).


3.2.Only participations that comply with all of the above stipulations will be accepted. In this regard, the Promoter reserves the right to make all necessary checks regarding the identity, age and contact details of each participant. Any incomplete, erroneous, or falsified information that does not allow the participant to be identified or located will result in the cancellation of his or her participation.


3.3. To enter, participants must:

  • Connect to the Internet on the social networks Instagram or TikTok after the start and before the end of the Contest,
  • Submit their relevant cover of the clip “See You in Hell” (via Instagram or TikTok),
  • Sign the publication with the competition hashtag “#SeeYouInHellCover”.

3.4. Only one entry per person is permitted during all of the duration of the Contest period. Multiple entries will be disqualified.


3.5. Contents submitted during the Contest, will not be accepted and will not allow the validation of the participation of their author if:

  • They are defamatory, abusive, obscene, offensive, violent or inciting to violence, political propaganda, religious/proselyte, racist or xenophobic;
  • They are contrary to morality and/or public order;
  • They feature or mention alcohol or tobacco in any way; or
  • More generally, they are contrary to any applicable laws.

4. Prizes


4.1. The prize for the Contest is a PR Kit for the two (2) top participants (the “winners”), including:

  • A Fanny Pack
  • Badges
  • Pins
  • Stickers
  • Mediators
  • Notebook
  • Pen

4.2. The prize is non-transferable, non-refundable, and no cash alternative is available.


4.3. The Promoter reserves the right to substitute the prize with another of equivalent value without giving notice.


5. Winners selection and notification


5.1. One winner will be selected by the Promoter and the other one by Nora Kelly from all eligible entries received during the Contest period. The winners will be selected based on their originality and link to the game and song universe.


5.2. The winner will be notified by direct message on the social media used for application (Instagram or TikTok), within 72 (seventy-two) hours after the end of the Contest. The winner must respond within 24 (twenty-four) hours to claim the prize. 


5.3. If the winner cannot be contacted or fails to respond within the required time period, the Promoter reserves the right to select an alternative winner.


5.4. The Promoter will send the prize to the winner within two (2) weeks after the winners’ confirmation.


5.5. The delivery of the prize, although carried out in the best interest of the winners, will be carried out at the risk of the winners. It is specified that the Promoter will not provide any service or guarantee linked to the use of the prize, its only obligation consisting of the free shipping of the prize of the Contest.


6. Publicity


6.1. By the sole reason of their participation in the Contest, each of the winners authorizes, free of charge, the Promoter to use their name, pseudonym, first name(s), cover and creations, image as well as, where applicable, all other attributes of their personality, as soon as they have been made available to the Promoter as part of its participation in the Contest, for the purposes of communication relating to the Contest exclusively, by all digital and/or analog processes, on all media, for the entire world and for a period of five (5) years from the end of the Contest.


7. Data Protection


7.1. The personal data communicated by the participants may be subject to process by the Promoter, responsible for this processing of personal data.


7.2. The personal data collected as part of the Contest are intended to be processed in order to manage participation in the Contest, to communicate about the Contest within the limits provided by the Terms, to contact the winner, in pursuit of the legitimate interests of the Promoter, or in order to respond to any request from any data subject. The Promoter is the only one with the right of access to the recorded data, which is not intended to be transmitted outside the European Union.


7.3. The Promoter will retain personal data only for the period necessary to pursue the purpose of the processing set out above, and in accordance with the applicable regulations.


7.4. In accordance with Law No. 78-17 Informatique et Libertés of January 6, 1978, as amended and EU Regulation 2016/679 known as the General Data Protection Regulation, participants have the right to object to the personal data processing. However, in the event that a participant exercises his right of opposition, he will see his participation automatically cancelled, his personal data being necessary for the management of his participation.


7.5. Participants also have a right of access, rectification, deletion, limitation or portability of personal data by writing to the following address: privacy@dont-nod.com. Everyone also has the right to lodge a complaint with a supervisory authority.


8. Limitation of Liability


8.1. The Promoter accepts no responsibility for any damage, loss, liabilities, injury, or disappointment incurred or suffered by any entrant as a result of entering the Contest or accepting the prize.


8.2. It is expressly recalled that the Internet is not a secure network. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, or any website. Consequently, the Promoter cannot be held responsible in particular for contamination by possible viruses or the intrusion of a third party into the terminal system of the participants in the Contest and declines any responsibility for the consequences of the connection of the participants via the Internet.


8.3. Generally speaking, the Promoter may cancel all or part of the Contest if it appears that fraud has occurred in any form whatsoever, in particular electronically in the context of participation in the Contest or determination of the winner. In this case, it reserves the right not to award the prize to a fraudster and/or to prosecute the perpetrators of this fraud before the competent courts. However, it cannot incur any liability of any kind towards participants due to any fraud committed.


8.4. It is understood that if the Contest is offered via one or more “social media” type platforms, the companies operating these platforms are neither partners, nor guarantors, nor linked in any way to the Promoter or to the Contest.


9. General


9.1. The Promoter reserves the right to cancel or amend the Contest and these Terms at any time without prior notice.


9.2. These Terms will be governed by and construed in accordance with the laws of the French Republic. Any disputes arising in connection with the Contest will be subject to the exclusive jurisdiction of the courts of the French Republic.

11. Intellectual Property


The DON’T NODTM, LOST RECORDSTM and BLOOM AND RAGETM brands, as well as any communication media relating to the Contest, remain the exclusive property of the Promoter.


The INSTAGRAMTM brand remains the exclusive property of the METATM company, which is not linked, directly or indirectly, to the organization of the Contest.


The TIKTOKTM brand remains the exclusive property of the BYTEDANCETM company, which is not linked, directly or indirectly, to the organization of the Contest.
